NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Lonoke County


REQUEST FOR RELEASE OF FUNDS

On or after December 3, 2019 the County of Lonoke will submit a request to the Arkansas Economic Development Commission for the release of ACEDP funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following project:


Project Title: Lonoke County Wade Knox Child Advocacy Center


Purpose: Addition and renovation of the existing facility for use by the Wade Knox Child Advocacy Center.


Location: 1835 W. Front Street, Lonoke, AR 72086, (34.461265N, 91.542926W)


Project Description: This project is to add an additional 2,931 sq. ft. metal building to the current building and renovations inside the current building. The project entails the addition of a pre-engineered metal building structure measuring 50’-3” x 56’-5” linked by an 8’-0” wide corridor, for a total of approximately 2,931 square feet. This proposed addition is roughly the same size as the previous addition to the facility. The preliminary design for this phase includes a large multipurpose room for assembly and gathering, a catering kitchen, a single accessible restroom, offices, storage, and a “care closet” from which the Center may distribute needed supplies. Approximately 735 S.F. within the existing facility will be renovated to create three new offices and a conference room in the former community room space. Surrounding environment is open land with a few structures that will not be adversely affected.


Project Issues: Standard construction permits and one for Stormwater Conservation because this is a construction project.


Mitigation Measures/Conditions/Permits (if any): Required permits will be obtained prior to start of construction.


Estimated Project Cost: $404,200.00


FINDING OF NO SIGNIFICANT IMPACT

Lonoke County has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Central Arkansas Planning and Development District, Inc., 902 N. Center Street, Lonoke, AR 72086 and may be examined or copied weekdays 8:00A.M to 4:30P.M.


PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the Central Arkansas Planning and Development District, Inc., P.O. Box 300, Lonoke, AR 72086. All comments received by 4:30pm on December 2, 2019 will be considered by Lonoke County prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.


RELEASE OF FUNDS

Lonoke County certifies to Arkansas Economic Development Commission that Doug Erwin, Certifying Officer, in his capacity as Lonoke County Judge consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. Arkansas Economic Development Commission’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Lonoke County to use ACEDP program funds.


OBJECTIONS TO RELEASE OF FUNDS

Arkansas Economic Development Commission will accept objections to its release of fund and Lonoke County’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases:

(a) The certification was not executed by the Certifying Officer of Lonoke County;


(b) Lonoke County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58;


(c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by Arkansas Economic Development Commission; or


(d) Another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Grants Management Division, Arkansas Economic Development Commission, 900 West Capitol, Suite 400, Little Rock, Arkansas 72201. Potential objectors should contact Arkansas Economic Development Commission to verify the actual last day of the objection period.
